1. Acceptance of Terms

By accessing or using Daily Noted ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

2. Description of Service

Daily Noted provides a free, web-based tool for creating self-destructing encrypted notes. Messages are encrypted in your browser using AES-256-GCM before being transmitted to our servers. Notes are permanently deleted upon first reading.

3. Acceptable Use

You agree not to use the Service to:

Transmit any content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
Distribute malware, viruses, or any other harmful software
Engage in phishing, fraud, or identity theft
Violate any applicable local, state, national, or international law
Attempt to circumvent, disable, or interfere with security features of the Service
Send unsolicited bulk messages (spam)

We reserve the right to terminate access to the Service for any user who violates these Terms.

4. No Guarantee of Delivery

While we strive to provide reliable service, Daily Noted does not guarantee that every note will be successfully delivered or read by its intended recipient. Notes may be lost due to server failures, network issues, or other technical problems. The Service is provided on an "as-is" basis.

5. Encryption and Security Disclaimer

Daily Noted uses AES-256-GCM encryption via the Web Crypto API. While this is considered strong encryption by current standards, we make no absolute guarantees about the security of your data. You use the Service at your own risk. For highly sensitive information (e.g., classified government data), consult a security professional.

6. Intellectual Property

The Service, including its design, logos, code, and content (excluding user-submitted notes), is the property of Daily Noted and is protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

7. User-Generated Content

You retain ownership of any content you submit through the Service. By using the Service, you grant Daily Noted a limited, temporary license solely to store and transmit the encrypted version of your content for the purpose of delivering it to the intended recipient. This license terminates when the note is deleted.

8. Limitation of Liability

To the fullest extent permitted by law, Daily Noted shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Service. In no event shall our total liability exceed $100 USD.

9. Indemnification

You agree to indemnify and hold harmless Daily Noted and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service or violation of these Terms.

10. Modifications

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last updated" date. Continued use of the Service after changes constitutes acceptance of the new Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the applicable jurisdiction, without regard to conflicts of law principles.
